Torts are civil wrongs that have been committed against a person that resulted in their injury or in destruction of their life and well-being. Torts differ from criminal cases because they concentrate on the harm done to a specific individual (or individuals) whereas criminal wrongs are concerned with the harm done to society as a whole. At times, tort law and criminal law can overlap, but for the most part, torts are about providing relief to those who have been injured or have lost their property due to someone else’s negligence. The Three Types Of Torts

Intentional Torts
Intentional torts include situations where a person intentionally commits harm against another person or acts in a way that they know will hurt another person, damage their property, or harm their reputation. Intentional torts are the kinds of torts that get most often mistaken for crimes, because they often involve violence.
However, if the situation happens between people and doesn’t have societal consequences, then the case will go to civil court. Sometimes, intentional harm can be classified as both a tort and crime. Nevertheless, people will likely want to pursue civil cases over criminal cases because victims will typically recover greater compensation from civil cases. Examples of intentional torts include:
- Assault
- Battery
- Fraud
- Infliction of emotional distress
- Trespassing
- Defamation
- False imprisonment

Negligence Torts
The most common types of torts are negligence torts. Negligence torts are different from intentional torts in that they occur when a party fails to act in a reasonable and prudent manner and their actions result in damages. Driving in an unsafe manner, failure to upkeep your property, or not keeping your aggressive dog on a lease could all be actions that are negligent and could result in injuries. Examples of negligence torts include:

Strict Liability Torts
Strict liability torts include cases where an injury occurs without evidence of harmful intent or obvious negligence. Basically, in strict liability cases, a person has been injured and their injuries were caused by another person’s actions, but the person who caused the injuries was trying to take the proper precautions to avoid hurting anybody. However, even if a person does not intend to cause harm and takes appropriate levels of care, they can still be held liable for injuries to another person. Examples of strict liability torts include abnormally dangerous activities, animal attacks, and defective products.

I had a great experience with LeBaron & Jensen P.C. I was driving westbound on Highway 193 in Clearfield Utah, when I came to the intersection of 1000 East and Highway 193. I noticed that a firetruck was travelling east towards the intersection with its emergency lights on, all traffic around me, including myself, slowed to a stop to allow the firetruck an unimpeded path to travel. However, I noticed the Jeep behind me wasn’t slowing down. There wasn’t anything I could do to avoid the collision, so I just braced for impact. Although I was wearing my seatbelt, I still suffered many injuries to my neck, shoulders, back, and arms. About a month after the accident I finally sought medical help for my injuries. I underwent many years of treatment for my accident-related injuries, including a carpel tunnel surgery and 2 rhyzotomy procedures, x-rays, MRIs causing me to incur over $60,000 in medical expenses. I decided I should seek legal help with my case, as I knew there was no way I could pay my medical expenses on my own. The legal team at LeBaron & Jensen were exceptional. They were able to negotiate with my health insurance and medical providers, lowering costs where they could. When all my legal and medical fees were paid, I was left with over $79,000. LeBaron & Jensen did a great job for me, kept me informed throughout the process, and helped make sure that I got the compensation I needed. I would absolutely recommend them to anyone who is suffering after an accident like mine. I was driving eastbound on Highway 193, a four-lane highway in Layton, Utah. I came to a stop at the two-way intersection of Highway 193 and North Hills Drive. The other driver failed to yield to my right-of-way and proceeded southbound through the intersection, I wasn’t able to stop fast enough, and I T-boned the other vehicle at a high speed. The impact of the crash was so severe that it triggered my vehicle’s airbags. The severity of the crash caused many serious and extensive injuries to my neck, back, shoulders, and head. Thankfully, I was restrained by my seatbelt, which prevented any worse injuries. I had to receive treatment for over a year and a half following the accident, including surgery on one of my shoulders. I was faced with $76,000 in medical bills. After paying all my medical and legal fees, I was still able to pocket $51,000 to compensate for the pain, and suffering I endured because of the accident.

In January of 2014, my husband was involved in a terrible accident. He was driving on highway 89 in Wellsville, UT, when another driver ran a stop sign and pulled out in front of him. He tried to swerve out of the way, but he wasn’t able to avoid hitting the other vehicle.
